Please read these Terms carefully as these constitute a binding legal agreement between you and Traders United. By using this Site and the related Services, you unconditionally agree to be bound by these Terms, including all exclusions and limitations of liability herein, and warrant that you have full authority and capacity, legal and otherwise, to use the Services. You may not access or use this Site or the Services if you do not agree to any part of these Terms.  

These Terms limit the remedies available in the event of a dispute and require that all disputes be resolved through binding arbitration. This means you agree to resolve disputes individually according to the arbitration provisions below rather than in a court of law or through a class action lawsuit.  

Acceptance of Terms 

This website, https://tradersunited.com (the "Site", including all subdomains), is a copyrighted work belonging to Traders United, which is a trade name of a registered company, TRU Innovations (Pty) Ltd. ("we," "us," and "our ").  

These Terms and Conditions (the "Terms") govern your access to and use of the Services available on the Site (the "Services").  

The terms “you,” “your,” and “user” or “users” refer to the person accessing, browsing, searching, or otherwise using any of TRU’s platforms. In addition, users who are registered and verified members of the organization shall also be referred to as “clients”, “members”, or “partners”. Users not registered with the organization shall also be referred to as “visitors.”

“Registered” means that a user has filled out and submitted a registration form through the appropriate channels on the company’s website. “Verified” means that a user’s registration process has been completed, and the company has confirmed and verified the user’s identity.

In addition, specific features of the Site may have additional rules and terms associated with them, and such additional rules and terms will be prominently posted or otherwise made available to each user and are incorporated herein by reference.

To access and use the Site, you must be at least eighteen (18) years of age or the age of majority as determined by the laws of your jurisdiction, whichever is greater ("Legal Age"). By using the Site, you affirm and represent that you meet the Legal Age requirement and have the legal capacity to enter into and be bound by these Terms of Use.

In the event of a breach of these Terms of Use, whether in part or in full, Traders United reserves the right to take any appropriate measures we see fit, based on the specific circumstances of the breach. Actions we may consider include, but are not limited to, suspending your access to the Site and Services, blocking your access, or terminating your account. We will exercise our discretion to ensure that the integrity of our platform is maintained.

License to Use Website

The Site primarily functions as an e-commerce platform. By these Terms, you are hereby granted a personal, global, non-transferable, non-exclusive, royalty-free, limited license to access and utilize the Site. This license is granted solely for the purpose of enabling you to use and benefit from the Services offered by the Site, and it must be used in a manner consistent with these Terms.

Advertising on the Site

Our Services may feature advertisements, which could be tailored based on the content of the Site, your search queries, or other data, whether provided by you or collected from other sources. The nature and frequency of these advertisements within the Site or as part of the Services are subject to variation.

Prohibited Uses of the Site

By accessing and using this Site, you agree to abide by these Terms and adhere to all applicable laws and regulations, including those at the local, national, and international levels that pertain to your jurisdiction. Our head office is in Botswana, and while we primarily cater to a global audience, users must ensure that their use of the Site complies with the laws applicable in their respective countries. We do not guarantee that the Site is legal or accessible in all jurisdictions outside of Botswana. In accordance with these Terms, you are authorized to view, print, and utilize our content and Services as allowed on the Site, strictly for personal and non-commercial purposes. Furthermore, you acknowledge that your interaction with this Site and the Services may involve transmitting electronic data across international borders as part of our network operations. This may include, but is not limited to, conducting searches, uploading files, posting content, sending instant messages, or communicating via email.

Access to and use of the Site are subject to the following restrictions unless explicitly authorized by us in writing:

  1. Engaging in activities that damage, impair, or interfere with the Site's functionality or the ability of visitors to access and utilize the Services, including any unlawful or fraudulent use.
  2. Uploading, transmitting, or distributing content that includes or is linked to malicious software such as viruses, spyware, or other harmful computer code.
  3. Conducting unauthorized data collection activities on or related to the Site or its users, including data mining, scraping, or harvesting without consent.
  4. Compiling or collecting information about other users without their consent.
  5. Using automated tools or scripts for data extraction or to generate excessive traffic on the Site, except for public search engines operating within the limits of our robots.txt file for indexing purposes.
  6. Sending unsolicited communications or engaging in marketing activities such as spamming or sending chain letters through the Site.
  7. Replicating, redistributing, or commercially exploiting any content from the Site without proper authorization.
  8. Altering, modifying, or creating derivative works from the Site's content or the Services without permission.
  9. Using the Site to develop a competing business or service.
  10. Engaging in activities that infringe on the rights of others, including intellectual property and privacy rights, or that are harmful, offensive, or inappropriate.
  11. Disrupting or overloading the Site's servers or networks.
  12. Attempting unauthorized access to the Site or its associated networks.
  13. Harassing, stalking, or negatively impacting another user's experience on the Site.

Compliance with Laws

Given the worldwide reach of the internet, you acknowledge and agree that it is your responsibility to ensure your use of the Site adheres to all applicable local and international laws. Furthermore, the import and export regulations of various countries, including but not limited to Botswana, may be applicable to your use of the Site.

You commit to not exporting, uploading, posting, or transferring any software, technical data, or technology obtained through the Site or our Services in breach of such import or export regulations. This includes, but is not limited to, adhering to regulations such as the Botswana Control of Goods, Import and Export (Commerce) Regulations, international standards like the European Union's Dual-Use Regulation, and sanctions programs, as well as the relevant laws and regulations of Botswana and other jurisdictions.

Becoming TRU Members

Users of the Site are allowed to create user accounts or profiles. Upon registering for our Services, you become a "Member" of the Site. You affirm that all information provided during account creation is accurate and truthful, and you commit to keeping this information updated.

As a member, you are the sole authorized user of your account and are responsible for maintaining the confidentiality of your password and account access details. It is advisable to take measures to secure your account and any devices used to access it. You bear responsibility for all activities conducted under your account and acknowledge that we are not liable for unauthorized access resulting from the misappropriation of your account or password.

Members are prohibited from transferring their accounts and passwords to others. If you suspect any unauthorized use or security breach of your account, you must notify us immediately. Traders United cannot be held liable for any loss or damage arising from your failure to secure your account. You may delete your account at any time for any reason by following the instructions on the Site.

To become a member of Traders United, users must complete our registration process, which includes subsequent verification. By submitting a registration form, you agree to the company's Terms and Conditions and authorize Traders United or its representatives to conduct background checks and investigations to verify the authenticity of the information provided.

Members are subject to the rules, regulations, and Terms and Conditions applicable to all users, in addition to specific rules, regulations, and Terms that apply exclusively to members. Traders United reserves the right to suspend or terminate your account at any time and for any reason, as detailed in the succeeding sections of this Terms of Use.

Right to Review and Take Action

Traders United reserves the authority to monitor and evaluate your use of the Site to ensure compliance with these Terms of Use. Should your actions be found to violate these Terms or result in any form of liability, loss, or harm to us, our Site visitors, or any third party, we hold the sole discretion to implement appropriate measures. Such measures may include, but are not limited to, the following actions: 

  1. Limiting your account privileges to prevent further violations.
  2. Terminating your account to halt any ongoing or potential misuse.
  3. Initiating legal proceedings to recuperate any financial losses incurred due to your actions.
  4. Reporting your activities to relevant law enforcement agencies if your conduct is deemed unlawful or poses a significant threat.

By using the Site, you acknowledge and agree to our right to take these actions to maintain a safe and compliant online environment for all users.

Third-Party Resources

The Site may feature links to and advertisements for websites, services, and other resources operated by third parties ("Third-Party Resources"). By using the Site, you acknowledge that these Third-Party Resources are beyond our control, and we are not accountable for their content, products, or services.

Our provision of access to Third-Party Resources is solely for your convenience and does not imply our monitoring, endorsement, or approval of these resources. We make no representations or warranties regarding the quality, safety, or reliability of Third-Party Resources.

As a user of the Site, you are responsible for exercising due diligence and caution when interacting with Third-Party Resources. It is important to note that any risks associated with the use of these resources, including but not limited to data privacy, security, and legal compliance, are assumed entirely by you.

Modifications and Termination

Traders United reserves the right to modify, supplement, suspend, or discontinue all or any portion of the Site and its Services at our discretion, with or without prior notification. This includes the authority to impose limitations on the usage of our Services and data storage by our visitors.

By utilizing the Site, you acknowledge and agree that we shall not be held liable for any actions taken in exercising the rights outlined in this clause. Any modifications or updates to the Site, unless specifically stated otherwise, will fall under the purview of these Terms of Use, and your continued use of the Site constitutes acceptance of these changes.

Members Support and Website Maintenance

While we may, at our discretion, offer customer support services or conduct website maintenance activities, it is important for you to understand that we are not obligated to provide such support or maintenance. Our decision to offer these Services is purely voluntary and may be subject to change based on our operational requirements and resource availability.

You acknowledge and agree that your use of the Site and its Services does not entitle you to any guaranteed level of customer support or ongoing website maintenance. We strive to ensure a positive user experience, but we reserve the right to adjust our support and maintenance offerings as necessary.

Access to Restricted Areas

Traders United may designate certain sections of the Site as restricted, accessible only to specific users who have been granted permission. If you are authorized to access these restricted areas, you are responsible for maintaining the confidentiality of your access credentials, including your password. You agree not to share these details with any third party.

The scope and accessibility of restricted areas may be subject to change as we continuously strive to improve the Site. If you are not granted access to these restricted sections, you agree to respect these limitations. You must not use another user's account or engage in any unauthorized methods to gain access to restricted areas of the Site.

Your adherence to these guidelines helps maintain the security and integrity of the Traders United platform, ensuring a safe and respectful environment for all users.

Intellectual Property Rights

All intellectual property rights in the Traders United Site and its contents are owned by TRU Innovations (Pty) Ltd. or its authorized licensors unless otherwise specified. These rights include, but are not limited to, the ownership of all text, graphics, images, logos, copyrighted material, trademarks, patents, software, and distinctive brand features presented on the Site or through our Services, as well as the compilation of any of these elements.

Your use of the site and acceptance of these Terms grant you limited rights and do not convey any intellectual property rights to you or any third party. TRU Innovations (Pty) Ltd reserves all rights not expressly granted in these Terms, and no implied licenses are conferred.

You are required to retain all copyright, trademark, and other intellectual property notices on any copies of content from the Site or Services. Without our express prior written consent or the respective third-party content owners, you may not publish, reverse engineer, modify, distribute, transmit, sell, create derivative works from, or commercially exploit any content from the Site or Services, either in whole or in part. Under no circumstances is the content of the Site intended for resale.

We expect you to respect the intellectual property rights of others when using the Site and Services. In the event of a copyright infringement claim, we will take appropriate action in accordance with applicable laws.

To report an infringement of your copyrighted material, please provide us with the following information:

  1. A physical or electronic signature of the copyright owner or their authorized representative.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material claimed to be infringing, with sufficient detail to allow us to locate it on the Site.
  4. Your contact information, including address, telephone number, and email address.
  5. A statement by you that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

We reserve the right to remove any content alleged to be infringing at our sole discretion, without prior notice, and liability to you. Additionally, we may take further action against users who are found to be repeat infringers, including terminating their accounts.

Be aware that making false claims of copyright infringement can have legal consequences. Under provisions similar to those found in the Copyright and Neighbouring Rights Act of Botswana, any material misrepresentation in a notice of alleged copyright infringement may subject the complaining party to liability for damages.

Refund Policy

We offer a range of additional Services. Please note that all sales of these Services are final and non-refundable. By purchasing any of our Services, you acknowledge that you are gaining access to digital, electronic, and physical content and future-scheduled events that, once accessed, cannot be returned, exchanged, or refunded.

Upon purchasing a Service, you are granted access to various materials and resources. Your access to these materials signifies your acceptance of our no-refund policy. The completion of your purchase is considered final, regardless of the extent to which you engage with the provided resources.

Users have the full responsibility to carefully consider their needs and the nature of our Services before making a purchase. Our team provides content and support to help you achieve your trading goals.

The Site offers a variety of digital media content and membership programs and Services. Due to the nature of these offerings, all fees, membership charges, and purchases are non-refundable.

Membership Fees, Renewals and Cancellations

Once paid, membership fees for Traders United are non-refundable. To avoid automatic renewal charges, members must submit a cancellation request at least eight days before their next scheduled renewal date. Any cancellation requests received less than eight days before the renewal date will be processed for the following billing cycle, and the current period will remain active and billable.

For cancellations, members must provide notice at least eight days before their next scheduled renewal date. Cancellations received less than eight days before the renewal date will not be eligible for a refund and will take effect in the subsequent billing cycle. Once a member has purchased a bundle and accessed any of the included resources, no refunds will be issued under any circumstances.

All members are responsible for reviewing their membership Terms and planning their cancellations accordingly to ensure a smooth transition.

We reserve the right to modify these Terms and Conditions at any time without prior notice. By continuing to use our Services, you agree to comply with the updated Terms and Conditions.

Acknowledgment of Risks and Disclaimers

By acquiring Services from Traders United, users acknowledge the inherent risks associated with trading. Trading financial instruments may not be suitable for all investors and always involves high risks, including, but not limited to, losing all or part of your investments. Some financial instruments and/or assets may also carry more risks than others.  Users are advised that any trading information and data found on the Site is not necessarily in real-time or accurate. The educational content on the Site is not necessarily provided by market experts or should be taken as professional trading advice. Moreover, while said contents may be representative of current trends and/or sentiments at the time of writing, markets are subject to constant changes and fluctuations and can make some of these contents obsolete, misleading, or inaccurate. Users have the full responsibility to verify the accuracy of the content they are reading.  

Despite these risks, our policy is clear: all purchases are final and non-refundable. We understand the desire to seek a refund in light of losses, but we stand by the quality of our Services and materials, which are designed to enhance users' understanding and proficiency in trading.

Users have the responsibility to invest only what they can afford to lose and to thoroughly familiarize themselves with the Terms and Conditions of our Services before making a purchase. Under no circumstances will refunds be issued due to dissatisfaction with trading results based on the recommendations or contents found on the Site.

Our Services are intended to provide users with the knowledge, tools, and skills needed to trade online. However, they do not guarantee profitable outcomes. By purchasing our Services, users are acknowledging and accepting these risks and our no-refund policy.

Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Site is provided to you on an "as-is" and "as-available" basis, without any representations or warranties regarding the content on the Site. Traders United, along with its subsidiaries, officers, employees, contractors, affiliates, partners, suppliers, agents, and licensors, expressly disclaims all warranties and conditions of any kind, whether express, implied, or statutory. This includes, but is not limited to, warranties or conditions of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, and non-infringement.

We do not guarantee that the Site, its content, or the Services will be continuously available, uninterrupted, useful, accurate, non-misleading, timely, reliable, complete, error-free, secure, free of viruses or other harmful code, legal, or safe. No advice or information, whether oral or written, obtained from Traders United or through the Site or Services, will create any warranty not expressly stated herein.

Your use of the Site and Services is at your sole risk. Traders United assumes no responsibility for any harm to your computer system, loss of data, or any other damage that may result from your access to or use of the Site and Services. By using the Site, you waive any and all claims and causes of action that may cause damage to your computer or internet access.

The content on the Site is provided for informational purposes only and should not be considered as legal, financial, medical, or professional advice. We encourage you to seek appropriate professional advice for your specific needs.

If the law in your jurisdiction requires any warranties with respect to the Site, such warranties are limited in duration to ninety (90) days from the date of first use. Some jurisdictions do not allow the exclusion or limitation of certain warranties, and therefore the above disclaimers and limitations may not apply to you. Nothing in this section is intended to limit any rights you may have that cannot be lawfully limited.

Limitation of Liability

To the fullest extent allowed by applicable law, Traders United, along with its subsidiaries, officers, employees, contractors, affiliates, partners, suppliers, agents, and licensors, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses. This includes, but is not limited to, losses or liabilities resulting from:

Your access to, use of, or inability to access or use the Services.

  1. The cost of procuring substitute goods or services.
  2. Any conduct or content of any third party on the services, including, without limitation, any defamatory, offensive, or illegal conduct.
  3. Any content obtained from the Services.
  4. Unauthorized access, use, or alteration of your transmissions or content.
  5. Other matters related to the Site or Services.

These limitations apply even if we have been expressly advised of the potential loss or liability.

In no event shall our aggregate liability exceed the greater of one hundred and twenty U.S. dollars (120.00 USD) or the amount you paid us, if any, in the past six months for the Services giving rise to the claim. The existence of more than one claim will not enlarge this limit. You agree that our affiliates, partners, suppliers, agents, and licensors will have no liability of any kind arising from or relating to your use of the Site or Services. You further agree not to bring any claim personally against our subsidiaries, officers, employees, contractors, agents, affiliates, partners, suppliers, or licensors.

The limitations in this section apply regardless of the theory of liability, whether based on contract, tort (including negligence), warranty, statute, or otherwise.

Some jurisdictions prohibit the limitation or exclusion of liability for incidental or consequential damages, and therefore the limitations and exclusion above may not apply to you. The foregoing does not affect any liability that cannot be excluded or limited under applicable law.

Indemnification

You agree to indemnify, defend, and hold harmless Traders United and its subsidiaries, officers, employees, contractors, agents, affiliates, partners, suppliers, and licensors from any claims, disputes, or demands, including reasonable legal and accounting fees, made by a third party arising out of your use of the Site, your breach of these Terms, your violation of any applicable law, or your posting, modifying, or transmitting content through the Site or Services.

We reserve the right, at your expense, to take exclusive control of the defense of any claim or dispute for which you are required to indemnify us. You agree to cooperate fully with us in the defense of such claims or disputes and not to settle any such claims or disputes without our prior written consent. We will make reasonable efforts to notify you of any such claim or dispute upon receiving notice.

Release of Claims

If you have a dispute arising out of, directly or indirectly, these Terms or your use of the Site or Services, you agree to release and forever discharge Traders United and its subsidiaries, officers, employees, contractors, agents, affiliates, partners, suppliers, and licensors from all related claims, actions, demands, disputes, damages, and liabilities, whether past, present, or future.

You expressly waive and release any rights you may have under any law or legal principle of similar effect in any jurisdiction, such as those that state that a general release does not extend to claims that the releasing party does not know or suspect to exist at the time of executing the release, and which, if known, would have materially affected the settlement. By doing so, you acknowledge that you are releasing all known and unknown claims you may have against us.

Termination

TRU reserves the right to terminate the access to the Site, Services, and membership in the organization of any members found to violate any of the company’s Terms and Conditions, acting against its best interests, or exhibiting any behavior that might cause the organization or any of its members harm or distress.

Erring members may be notified of their violation and given seven (7) calendar days to clarify and explain their behavior. The organization shall likewise conduct its own investigation during the said period. The organization shall consider the results of its investigation and the erring members’ explanation before announcing its decision one (1) day after the seven-day investigation period has elapsed. Members failing to provide justifications for their violations within the specified period shall automatically have their membership revoked.

Updates of Terms of Use

Traders United reserves the right to modify or revise these Terms of Use at any time, in our sole discretion. Changes will become effective immediately upon posting on the Site. Users have the responsibility to regularly review the Site, including this page, for any updates to stay informed. Your continued use of the Site and Services after any updates signifies your acceptance of the revised Terms.
